1. ACCEPTANCE OF TERMS
By engaging the services of 100 Percent Plumbing Portland ("Company," "we," "us," or "our"), you ("Customer," "Client," or "you") agree to be bound by these Terms of Service ("Terms"). These Terms constitute a legally binding agreement between you and 100 Percent Plumbing Portland. If you do not agree to these Terms, please do not use our services.

3. SERVICES PROVIDED
100 Percent Plumbing Portland provides residential and commercial plumbing services including, but not limited to: Emergency plumbing repairs, Drain cleaning and unclogging, Pipe installation and repair, Fixture installation and replacement, Water heater services, Leak detection and repair, Bathroom and kitchen plumbing, Sewer line services, Preventive maintenance
4. SERVICE AGREEMENTS AND ESTIMATES
4.1 Estimates: All estimates provided are approximate and based on initial assessment. Final costs may vary depending on actual conditions encountered during service delivery. We will inform you of any significant cost changes before proceeding with additional work.
4.2 Written Agreements: For projects exceeding $500, a written service agreement will be provided detailing scope of work, materials, labor costs, and timeline.
4.3 Emergency Services: Emergency service calls may be subject to premium pricing, particularly for after-hours, weekend, or holiday services.
5. PRICING AND PAYMENT TERMS
5.1 Payment Due: Payment is due upon completion of services unless otherwise agreed in writing. We accept cash, check, and major credit cards.
5.2 Late Payments: Accounts not paid within 30 days of invoice date may be subject to a monthly service charge of 1.5% (18% annually) or the maximum rate permitted by Portland law, whichever is less.
5.3 Collection Costs: Customer agrees to pay all costs of collection, including reasonable attorney's fees, in the event legal action is necessary to collect unpaid amounts.
5.4 Liens: We reserve the right to file a mechanic's lien against your property for unpaid services in accordance with Portland law.
6. WARRANTIES AND GUARANTEES
6.1 Workmanship Warranty: We warrant our workmanship for a period of two (2) years from the date of completion. This warranty covers defects in our labor but does not cover normal wear and tear, misuse, or damage caused by others.
6.2 Parts and Materials: Manufacturer warranties apply to all parts and materials. We do not extend or modify manufacturer warranties.
6.3 Warranty Limitations: Warranty service is limited to repair or replacement of defective work. We are not liable for consequential or incidental damages. Warranty service is also limited to materials or equipment supplied by the customer. We are not liable for securing or honoring a manufacturer's warranty on material that we did not purchase directly.
7. CUSTOMER RESPONSIBILITIES
7.1 Access and Preparation: Customer must provide reasonable access to work areas and ensure utilities are available as needed.
7.2 Accurate Information: Customer must provide accurate information about plumbing systems, previous repairs, and any known issues.
7.3 Property Protection: Customer is responsible for moving personal property and protecting belongings during service delivery.
7.4 Permits: Customer is responsible for obtaining necessary permits unless specifically included in our service agreement.
8. LIMITATION OF LIABILITY
8.1 Maximum Liability: Our total liability for any claim arising from our services shall not exceed the amount paid for the specific service giving rise to the claim.
8.2 Excluded Damages: We shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of use, or property damage not directly caused by our negligence.
8.3 Property Damage: We maintain general liability insurance and will repair or replace property damaged due to our negligence, subject to policy limits and deductibles.
9. INDEMNIFICATION
Customer agrees to indemnify and hold harmless 100 Percent Plumbing Portland from any claims, damages, or expenses arising from: Pre-existing conditions not disclosed by Customer Customer's failure to follow our recommendations Interference with our work by Customer or third parties Violations of building codes or regulations by others
10. CANCELLATION AND RESCHEDULING
10.1 Customer Cancellation: Scheduled appointments may be cancelled with at least 24 hours notice. Same-day cancellations may be subject to a cancellation fee.
10.2 Company Cancellation: We reserve the right to cancel services due to unsafe working conditions, customer non-compliance, or other legitimate business reasons.
11. DISPUTE RESOLUTION
11.1 Governing Law: These Terms are governed by the laws of the State of Portland.
11.2 Jurisdiction: Any legal proceedings shall be conducted in the appropriate courts of Portland.
11.3 Mediation: Both parties agree to attempt resolution of disputes through mediation before pursuing litigation.
12. INSURANCE AND LICENSING
100 Percent Plumbing Portland maintains appropriate licensing, general liability insurance, and workers' compensation insurance as required by Portland law. Proof of insurance is available upon request.
13. PRIVACY AND CONFIDENTIALITY
We respect your privacy and will not disclose personal information to third parties except as necessary to provide services or as required by law. We may use customer information for business purposes including marketing and quality improvement.
14. FORCE MAJEURE
We shall not be liable for delays or failures to perform due to circumstances beyond our reasonable control, including but not limited to natural disasters, government actions, labor strikes, or material shortages.
15. SEVERABILITY
If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect.
16. ENTIRE AGREEMENT
These Terms constitute the entire agreement between the parties and supersede all prior agreements or understandings, whether written or oral, relating to the subject matter herein.
17. MODIFICATIONS
These Terms may only be modified in writing and signed by both parties. We reserve the right to update these Terms with notice to customers.
18. SAFETY AND COMPLIANCE
18.1 Safety Standards: All work will be performed in accordance with applicable building codes, safety standards, and industry best practices.
18.2 Hazardous Conditions: If hazardous conditions are discovered during service delivery, work may be suspended until conditions are remediated by appropriate specialists.
19. EMERGENCY SERVICES DISCLAIMER
While we strive to provide prompt emergency services, response times may vary based on weather, traffic, and call volume. We do not guarantee specific response times for emergency calls.
